Terms of Use

The short version: Use PickyEatrs to find restaurants with your partner. Don't abuse the service. Subscriptions auto-renew until you cancel. We can update these terms, and we'll let you know if we do.

1. Acceptance of Terms

By downloading, installing, or using PickyEatrs ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app. These terms apply to all users, whether using the app anonymously or with an account.

2. Description of Service

PickyEatrs is a mobile application that helps couples decide where to eat. Users independently swipe on nearby restaurants, and the app reveals mutual matches. The app uses location data to find restaurants near you and displays information from third-party sources (Google Places). We do not guarantee the accuracy, availability, or quality of any restaurant listed in the app.

3. Accounts

You may use PickyEatrs without creating an account. If you choose to create an account (via email, Apple, or Google sign-in), you are responsible for maintaining the security of your login credentials. You agree to provide accurate information when creating your account.

You may delete your account at any time from the app's settings. Deleting your account permanently removes your profile, dining history, favorites, preferences, and partner pairing data from our servers. This action cannot be undone.

4. PickyEatrs Premium (Subscriptions)

Subscription options: PickyEatrs Premium is available as a monthly or annual auto-renewing subscription. Current pricing is displayed in the app before purchase.

Billing: Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may cancel your subscription at any time through your device's subscription settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period — you retain access to Premium features until then. We do not offer prorated refunds for partial billing periods.

Refunds: Refund requests are handled by Apple or Google, depending on where you purchased the subscription. We do not process refunds directly. Contact Apple Support or Google Play Support for refund inquiries.

Price changes: We may change subscription prices from time to time. Price changes take effect at the start of the next billing period following notice. If you do not agree to a price change, you may cancel before it takes effect.

Free trial: If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.

6. Intellectual Property

The PickyEatrs app, including its design, code, branding, and original content, is owned by us and protected by applicable intellectual property laws. Restaurant data, photos, and ratings are provided by Google and are subject to Google's terms of service. You may not copy, modify, distribute, or create derivative works based on the app without our written permission.

7. Third-Party Services

The app relies on third-party services including Google Firebase, Google Places API, RevenueCat, and Apple/Google authentication. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

8. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or that restaurant information will be accurate or current. Restaurant details (hours, menus, ratings, availability) are sourced from third parties and may be outdated or incorrect.

PickyEatrs is a decision-making tool — we are not responsible for your dining experience at any restaurant discovered through the app.

9. Limitation of Liability

To the maximum extent permitted by law, PickyEatrs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the app. Our total liability for any claim arising from your use of the app shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless PickyEatrs and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the app or violation of these terms.

11. Termination

We may suspend or terminate your access to the app at any time, with or without cause, and with or without notice. Upon termination, your right to use the app ceases immediately. If you have an active subscription, cancellation of the subscription through your device's settings is required to stop future charges.

12. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will update the effective date at the top and notify users through the app. Your continued use of the app after changes constitutes acceptance of the updated terms. If you disagree with changes, your remedy is to stop using the app and delete your account.

13. Governing Law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the app shall be resolved in the courts located in Georgia.
